During the 87th Regular Legislative Session, the Texas Legislature passed HB 1925 which established prohibitions on camping in public places, created a criminal offense in Texas Penal Code for prohibited camping, and established new Subchapter PP of Chapter 2306 of the Texas Government Code (Texas Statutes Website), entitled Property Designated by Political Subdivision for Camping by Homeless Individuals. It should be noted that TDHCA only has authority to implement Texas Government Code 2306 Subchapter PP; TDHCA is not a resource or enforcement entity as it relates to the other provisions of HB 1925. Please contact your local law enforcement agency or the Texas Attorney General’s office for questions in relation to the Penal Code provisions of HB 1925.

This addition to the Texas Government Code provides that a political subdivision may not designate a property to be used by homeless individuals to camp unless the Texas Department of Housing and Community Affairs (TDHCA) has approved a plan submitted by the political subdivision.

10 TAC §1.8 (Secretary of State Website), entitled “Plan Requirements, Process and Approval Criteria for Properties Designated for Camping Political Subdivisions for Homeless Individuals” can be found in the Texas Administrative Code here (Secretary of State website).
