TDHCA has announced a rule action relating to 10 TAC Chapter 1, Subchapter D, Uniform Guidance for Recipients of Federal and State Funds, 10 TAC Section 1.410 Determination of Alien Status for Program Beneficiaries, that was approved by the TDHCA Governing Board on November 6, 2025. This rule will be released for public comment and returned to the Board for final adoption.

The rule, including its preamble, is expected to be published in the Texas Register edition for November 21, 2025. The published version will constitute the official version for purposes of public comment and can be found at the following link: https://www.sos.texas.gov/texreg/index.shtml.

The purpose of this action: This rule relates to no longer allowing program recipients to receive benefits if they do not have legal residency/citizenship status. This rule revision makes checking for legal status a requirement for all of the Department's single-family, homeless and Community Affairs programs. It already does apply to some of them, but this adds the requirement to all of them and provides the mechanism for how to do so. The rule action item is specific only to the Single Family, Homeless, and Community Affairs programs operated by the Department; no action at this time is being taken relating to the Department's multifamily portfolio of rental properties or the single family bond or TBA activities. This rule will be returned to the Board for final adoption.
