TDHCA has proposed rule replacements relating to 10 TAC Section 2.302, Administrative Penalty Process, and 10 TAC Section 2.401, General, as approved by the TDHCA Governing Board on October 9, 2025. The rule will be open for public comment from October 24, 2025, through November 24, 2025. 

The rule, including its preamble, was published in the Texas Register edition of October 24, 2025, and that published version constitutes the official version for purposes of public comment and can be found at https://www.sos.texas.gov/texreg/index.shtml.

The proposed replacement rule for 10 TAC Section 2.302, Administrative Penalty Process, updates the administrative penalty schedule to address elevator noncompliance, minor technical corrections, and clarification relating to preferences and limitations. The proposed replacement rule for 10 TAC Section 2.401, General, includes alternative options for debarment in certain circumstances, addresses elevator noncompliance, clarifies areas of confusion, and streamlines procedures.
