Manufactured Housing Division
Section 1201.207(c) of the Occupations Code, requires that all parties reflected on the Statement of Ownership and Location (SOL) provide written consent or release their interest, either in writing or by operation of law, in order to issue a subsequent SOL.
Effective September 1, 2009, House Bill 2238 modified §1201.207(c) of the Occupations Code to exclude lenders who purchase loans, or companies who service loans, from this requirement, enabling these parties to update the lienholder information if it changes.
Until pending forms have been approved, the current procedure applies.
Current Procedure:
- Application for SOL
- Block 1 - Note LIEN ASSIGNMENT.
- Block 2 - Note HUD Label and Serial number.
- Block 3 - Note physical address of home.
- No signatures are needed on this form.
- Notice of Lien
- Block 1- Note HUD Label and Serial number.
- Block 2 - Show former lienholder on the left and purchaser of lien or loan servicer on the right.
- Block 3 - Leave blank.
- Block 4 - Former lienholder signs on the left and purchaser of lien/loan servicer on the right (proof of loan purchase, acquisition, servicing agreement, or Power of Attorney may be provided in lieu of the former lienholders signature.)

- Block 2 - Note HUD Label and Serial number.
- Block 3 - Note physical address of home.
- Block 9 - Show former lienholder on the left and purchaser of lien or loan servicer on the right.
- Block 10a – Signature of former lienholder.
- Block 10b – Signature of purchaser of the lien or loan servicer (proof of loan purchase, acquisition, servicing agreement, or Power of Attorney may be provided in lieu of the former lienholders signature.)
