The Manufactured Housing Division (“Division”) is committed to the protection of Texas Consumers by ensuring compliance with all federal and state manufactured housing laws through education and enforcement.
As a reminder, all complete Statement of Ownership applications must be submitted to the Division within 60 days of the date of sale. However, a recent enforcement initiative by the Division resulted in the discovery that many licensees were unsure as to what to use as the “date of sale, transfer or ownership change:” when submitting the application for Statement of Ownership (Block 4d).
After analyzing various provisions of state law collectively, in addition to industry common practice, and common understanding, “date of sale, transfer or ownership change:” required in block 4(d) on the Application for Statement of Ownership is interpreted to mean the:
“date of transfer, ownership change, or the date the full purchase price has been paid or funded by or on behalf of the buyer, or the delivery date, whichever is later.”
The Division is hopeful this clarification will educate and assist licensees in gaining compliance with the required filing deadlines.
