Notice of Implementation of Enforcement Initiative - Fine Increases Expected for Law Violators

The Manufactured Housing Division (“Division”) is committed to the protection of Texas Consumers by increasing compliance with all federal and state manufactured housing laws through education and enforcement. In an effort to improve the compliance of licensees who violate the law, the Division will be implementing a stricter standard of enforcement, which will include larger fines and additional education as a requirement for law violations.

In order to avoid any enforcement actions and increased fines, the Division recommends ensuring:

  • All complete Statement of Ownership applications are submitted on behalf of consumers within 60 days of the date of sale.
  • All Notice of Installations (Form T’s) are submitted within 7 days after the installation is complete.
  • Ensure all appropriate deposits are refunded within fifteen days after receiving written notice that a refund is requested.
  • Ensure all warranty orders are complied with, within the required 30 days or an extension is timely requested prior to the expiration of the 30 days, on the Department form.

The Division is hopeful these stricter standards will assist in encouraging compliance with all Manufactured Housing laws.
